ArvoLex represented the landowner in a precedent-setting case before the Supreme Court of Finland, where a radio mast had been placed on a private property without a new lease agreement. The previous 25-year lease had expired, and the right of placement had been granted to the company by the municipal building authority.
The expropriating party (the company) proposed that the compensation should be based on the market value of forestry land, but ArvoLex, on behalf of the landowner, argued that the compensation should be determined based on the yield value reflecting the property's prior use. The Supreme Court accepted our position and confirmed compensation of approximately EUR 18,000, based on the previous lease agreement.
The case affirms that in expropriations for special uses – such as telecommunications infrastructure – landowners are entitled to compensation that reflects their actual economic loss, not merely the general market value of the land.
